The Supreme Court today held that every citizen has the right to a speedy trial and that unreasonable delay in the disposal of criminal cases amounts to a violation of fundamental rights guaranteed under Article 21 of the Constitution of India. The bench comprising of three judges observed that the judiciary must take proactive steps to ensure that justice is not delayed. The court directed all high courts to submit a report within three months detailing the status of cases pending for more than five years. It was further held that the state governments must allocate adequate resources to the judiciary so that the cause of justice is served effectively and without undue delay.
